Who Can Be Released on Immigration Bond
Not everyone in immigration detention is eligible for bond. ICE determines initial eligibility, and an immigration judge can review the decision. Factors affecting eligibility include: immigration status, criminal history, ties to the community, and flight risk.

The Immigration Bond Process
The immigration bond process begins when ICE sets an initial bond amount, typically ranging from $1,500 to $25,000 or more depending on the case. If the family disagrees with the amount, they can request a bond hearing before an immigration judge.
Once bond is set, it can be posted through an immigration bond company or paid directly to ICE. The full bond amount must typically be posted - there is no 10% option as with state bail bonds.
